"The ʿulamāʾ and fuqahāʾ have affirmed that it is not permissible for a mukallaf person to undertake an action before knowing Allah’s ruling concerning it."
Our Mission
All praise belongs to Allah, He who has honoured us with the Dīn of Islam, and who says in His Noble Book: “So ask the people of remembrance if you do not know.” [Qurʾān 16:43]. May prayers and salutations be upon the master of masters, Muḥammad ﷺ, and upon his family and all his companions.
A necessity for every Muslim community is the knowledge and awareness of the various rulings within the Sharīʿa, as they pertain to the acts of those who are legally responsible [mukallaf]. The ʿulamāʾ and fuqahāʾ have affirmed that it is not permissible for a mukallaf person to undertake an action before knowing Allah’s ruling concerning it. One who is negligent in this matter places his own faith and his Hereafter in jeopardy, and deprives himself of the subtleties, wisdom, and ease embodied in the noble system of Islamic law.
Given this, it follows that the source from which a Muslim derives the rulings of his Dīn must be a trustworthy one, founded upon precise and clear scholarly principles, and grounded in the statements of upright and reliable ʿulamāʾ and fuqahāʾ. It is from this perspective that the project of the European Fatwa Council was established—in service to Muslims and to facilitate access to the essential rulings and practical guidance needed in their daily lives.
Vision
The European Fatwa Council endeavours to make the necessary juristic rulings of Islam accessible to Muslims throughout Europe in a clear and straightforward manner. This is primarily to cultivate confidence in the breadth and integrity of this upright Dīn, and to address the needs of Muslims who are legally accountable in the Sharīʿa. By responding to questions submitted to the European Fatwa Council, a senior panel of qualified scholars will formulate fatāwā rooted rigorous scholarly research that meets the needs of Muslims.
"This is primarily to cultivate confidence in the breadth and integrity of this upright Dīn, and to address the needs of Muslims who are legally accountable in the Sharīʿa."
"As per the spirit of the Sharīʿa, a method of facilitation and avoidance of undue will be adopted in a balanced manner, free from excess or negligence."
Methods & Guidelines
All fatāwā issued from the European Fatwa Council will be based upon the authentic statements of trustworthy scholars who have conveyed the commands of Allah, by drawing from the four established Sunnī legal schools [madhāhib], and identifying the relied-upon [muʿtamad] positions within them. Evidence from the Noble Qurʾān and Sunna will be referenced as appropriate to the context, and in order to strengthen confidence in the sources and connect Muslims directly to their foundations, the explicit texts of the fuqahāʾ explaining those āyāt and aḥādīth will be cited with complete referencing. Inconsistent opinions and anomalous views [shādhdh] will be avoided.
With an ever-changing world, contemporary events, contextual indicators, and modern developments will be taken into consideration when applying juristic rulings to practical circumstances. In fact, contemporary issues and unprecedented cases will be rigorously examined in accordance with established legal principles and informed by a sound understanding of modern events.
As per the spirit of the Sharīʿa, a method of facilitation and avoidance of undue will be adopted in a balanced manner, free from excess or negligence. Additionally, the essence of the Sharīʿa will be communicated through outlining the proper etiquettes associated with certain rulings, thereby illuminating the beauty of this Divine Law and reforming patterns of conduct in accordance with the ethical spirit of Islam.
